📌 Definitions

• Cooling-off period: The period within which the consumer may exercise their right of withdrawal.
• Consumer: A natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
• Day: A calendar day.
• Long-term transaction: A distance contract concerning a series of products and/or services where the delivery and/or purchase obligations are spread over time.
• Durable data carrier: Any means that allows the consumer or entrepreneur to store information personally directed to them in a way that makes future consultation and unchanged reproduction possible.
• Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
• Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.
• Distance contract: A contract where, in the framework of an organized system for distance selling of products and/or services, only one or more remote communication techniques are used until the contract is concluded.
• Remote communication technology: A means that can be used to conclude an agreement without the consumer and the entrepreneur being physically present in the same space simultaneously.

📌 Article 3 – Applicability

These terms and conditions apply to every offer from the entrepreneur and every agreement concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not possible, it will be indicated that the terms can be reviewed at the entrepreneur’s location or will be sent free of charge upon request.

If the contract is concluded electronically, these terms will be provided electronically in a format that allows easy storage and retrieval.

If specific product or service conditions apply alongside these terms, the consumer may always rely on the most favorable provision in case of contradictions.

If any provision of these terms is deemed invalid or voided, the rest of the contract and terms remain in force, and the affected clause will be replaced by a legally valid equivalent.

📌 Article 4 – The Offer

• If an offer has a limited validity period or is subject to conditions, this will be stated clearly.
• All offers are non-binding, and the entrepreneur reserves the right to modify or adjust offers.
• The offer includes a clear and accurate description of the product or service.
• Product images are a truthful representation, but color deviations may occur.
• The offer includes essential details like:
  ✔ Price (including taxes)
  ✔ Shipping costs (if applicable)
  ✔ Payment, delivery, and execution details
  ✔ The right of withdrawal (if applicable)
  ✔ The validity period of the offer

📌 Article 5 – The Agreement

• The contract is established once the consumer accepts the offer and meets the stated conditions.
• If accepted electronically, the entrepreneur will confirm receipt as soon as possible. Until confirmation is received, the consumer may cancel the contract.
• Security & Privacy: If the agreement is electronic, the entrepreneur ensures secure data transfer and safe payment methods.
• The entrepreneur has the right to deny an order if the consumer does not meet payment obligations or if other relevant factors justify rejection.
• Upon purchase, the consumer will receive:
  ✔ The entrepreneur’s business address for complaints
  ✔ Information on the right of withdrawal (if applicable)
  ✔ Product warranty and after-sales service details

📌 Article 6 – Right of Withdrawal

• Consumers may cancel their purchase within 14 days of receiving the product, without giving a reason.
• During this period, the consumer must handle the product and packaging with care and return it in its original condition.
• To withdraw, the consumer must notify the entrepreneur within 14 days via email. The consumer must return the product within another 14 days and provide proof of shipment.

If the consumer fails to notify withdrawal or return the item within the timeframes, the purchase is final.

📌 Article 7 – Return Costs

• The consumer bears the return shipping costs.
• If a refund applies, it will be processed within 14 days of receiving the returned product.

📌 Article 8 – Exclusions from the Right of Withdrawal

The entrepreneur may exclude returns for:

❌ Custom-made products
❌ Perishable goods
❌ Hygiene-sensitive products (e.g., underwear, cosmetics)
❌ Sealed software, DVDs, and CDs once opened

This exclusion is only valid if clearly communicated before purchase.

📌 Article 9 – Pricing

• Prices will not increase during the validity of the offer, except for tax changes.
• If a price increase occurs after 3 months, the consumer has the right to cancel the contract.
• Prices include VAT but exclude potential shipping fees.
• Errors & Omissions Disclaimer: The entrepreneur is not liable for printing or typographical errors.

📌 Article 10 – Warranty & Conformity

• The entrepreneur guarantees that the product/service meets the contract specifications and legal standards.
• Any warranty given by the manufacturer does not affect the consumer’s legal rights.
• Complaints must be submitted within 14 days of receiving the product.

📌 Article 11 – Delivery & Execution

• Orders are delivered to the address provided by the consumer.
• Orders are shipped within 30 days unless a longer timeframe is agreed upon.
• If delivery is delayed, the consumer may cancel the order and receive a refund within 14 days.

📌 Article 12 – Subscriptions & Cancellations

• Consumers can cancel an indefinite subscription at any time with one month’s notice.
• Fixed-term contracts cannot be automatically renewed beyond their initial duration.

📌 Article 13 – Payment

• Payments must be made within 7 days unless otherwise agreed.
• Consumers must report any inaccuracies in their payment details.
• If a consumer fails to pay, additional costs may apply.

📌 Article 14 – Complaints & Disputes

• Complaints must be submitted within 7 days of identifying an issue.
• The entrepreneur will respond within 14 days with a resolution or timeline.
• Unresolved disputes may be escalated through legal procedures.

📌 Article 15 – Governing Law

• These terms and conditions are governed exclusively by Dutch law, even if the consumer resides outside the Netherlands.
